Terms of service
The agreement between Try-On and the business using it: the service, tokens, what may be made, who owns what, and how either side ends it.
Published in English. English governs this document, whatever translation is provided.
Draft. This text has not been reviewed by a lawyer and is not the agreed version. It says what we intend to agree, so that it can be read and corrected before Try-On goes on sale.

1. Who these terms are between, and accepting them
1.1 Try-On is operated by ORCA-AD LTD, a company registered in Israel under number [company number: to be filled in], whose registered office is at [registered address: to be filled in] (“Try-On”, “we”, “us”, “our”).
1.2 These terms apply between us and the business that opens a Try-On account (“you”, “your”). You accept them by opening an account, by connecting a store, or by using the service.
1.3 Try-On is for businesses. By accepting these terms you confirm that you are acting for a business, trade or profession, that you are at least 18 years old, and that whoever accepts them has authority to bind that business. If you are not acting for a business, clause 23 applies to you as well.
2. Definitions
- Account — the Try-On account a business holds, which may have more than one store connected to it.
- Content Policy — the policy at try-on.co/content-policy, as changed from time to time.
- Tokens — the units spent on Results, bought in advance or given with the Free Allowance.
- DPA — the data processing agreement at try-on.co/dpa.
- Free Allowance — any number of Results we make available at no charge, as described in clause 6.
- Input — anything your store sends us for a Result: garment and product images, body-profile values, and the choices made with them.
- Payment Provider — the company that sells Tokens to you as seller of record, currently Freemius, Inc., of Wilmington, Delaware, United States.
- Plugin — the Try-On WordPress plugin, licensed GPLv2 or later.
- Result — a still or a video generated from an Input.
- Service — the Try-On service reached at connect.try-on.co, together with the Plugin.
3. The documents, and which wins
3.1 These terms, the Content Policy, the DPA and the privacy policy together form the agreement between us.
3.2 If they disagree, these terms win, except that the DPA wins on the processing of personal data and the Content Policy wins on what may be made.
3.3 The Payment Provider’s own buyer terms govern the purchase of Tokens and nothing else. The refund policy explains how the two fit together.
3.4 The Plugin is free software, licensed GPLv2 or later. Nothing in these terms limits any right you have under that licence in the Plugin’s code. These terms govern the Service you receive from us, not your use of the Plugin’s code.
4. The Service
4.1 The Service generates Results from Inputs: a still or a short video showing a generated model wearing the garment in your image, returned to your store.
4.2 We may change the Service, add to it and remove from it. Where a change materially reduces what you have already paid for, we will tell you before it takes effect.
4.3 No service level. We do not promise the Service will be available at any particular time, that a Result will be generated successfully, or that a Result will represent a garment accurately. We may suspend the Service for maintenance, security or the safety of others.
4.4 We do not monitor Results. We check an Input before generating from it, and we act on reports, but we do not review every Result, and we are not responsible for how you use one.
4.5 We may set limits on requests, concurrency and storage, and change them, to keep the Service working for everyone.
5. Your Account
5.1 You are responsible for everything done with your Account, and for keeping your sign-in details safe. Tell us at once if you think someone else has them.
5.2 One Account is for one business. You may connect several stores to it, and you are responsible for each.
5.3 The details you give us must be accurate, and you must keep them current.
6. The Free Allowance
6.1 We may make a Free Allowance available: a number of Tokens each month at no charge, which may be spent only on Results at the lowest quality we offer. What those Tokens make is on the pricing page.
6.2 The Free Allowance is per business, not per store, and is not cumulative: each month tops your balance up to the Free Allowance rather than adding to it, so what is unused at the end of a month does not carry over.
6.3 It comes with no service level of any kind, and clause 22.4 caps our liability for it separately.
6.4 We may change or withdraw the Free Allowance. We will say so before we do.
7. Tokens
7.1 Tokens are bought in advance and spent on Results. We show what a Result costs in Tokens before anything is queued, and nothing is queued that your balance cannot cover.
7.2 Tokens are not money. They have no cash value, cannot be exchanged for money, and cannot be transferred between Accounts or sold on.
7.3 Tokens stay on the Account while it is open. Closing the Account ends any that are unspent.
7.4 Buying Tokens is a one-time purchase. Nothing renews automatically, nothing is charged to you again without your asking, and there is no subscription to cancel.
7.5 Tokens do not expire, and we charge no fee for holding them. There is no dormancy, inactivity or maintenance fee of any kind. Your Account shows a number of Tokens, not a balance of money.
7.6 Tokens are not a gift certificate, a gift card, a voucher or stored value, and we do not sell them as any of those. They are prepayment for our own Service at the rate the price list sets, they are sold to businesses, and they can be spent only on this Service and only by the Account that holds them.
7.7 A render that fails at the generator still costs its Tokens, because we are charged for it either way. The Plugin says so before you confirm, and your usage record shows those runs.
7.8 The check of a garment image costs its Tokens even when the image is turned down.
7.9 Our records of what was generated and what it cost are what count, unless you show them to be wrong.
8. Money, tax and invoices
8.1 Two agreements, not one. Buying Tokens is a sale by the Payment Provider, which resells them as seller of record: it takes the payment, charges any tax due where you are, and issues the receipt or invoice, under its own buyer terms. Using the Service is this agreement, with us. So a question about a charge, a tax line or an invoice goes to the Payment Provider, and a question about a Result, an Account or a Token spent goes to us. We will help either way rather than send you back and forth.
8.2 What you buy from the Payment Provider is Tokens on your Account. The record of how many you hold and what they were spent on is ours, as clause 7.9 says, because the Service is where they are spent.
8.3 Prices for Tokens are exclusive of tax unless we say otherwise.
8.4 Refunds are dealt with in the refund policy.
9. Your Inputs
9.1 What you send us stays yours. We claim no ownership of it.
9.2 You grant us a worldwide, non-exclusive, royalty-free licence, which we may pass to the providers who run the Service for us, to host, store, copy, transmit, adapt and process your Inputs so far as is needed to provide the Service to you, to keep it secure, to prevent abuse, and to meet our legal obligations. The licence ends when the Input is deleted, except for copies kept in backups or held for a legal reason until they are deleted in turn.
9.3 You confirm that you may send us everything you send, and that using it as the Service does infringes nobody’s rights.
9.4 Photographs of people. You may send a photograph of a real person only where you hold that person’s written release, which names the creation of an AI-generated or digital replica of their likeness and the commercial uses you will make of it. You must keep it, and you must give us a copy if we ask.
9.5 Before we generate from such a photograph, you record a confirmation with us: that a conforming release exists, whom it covers, when it was given, and who in your business is confirming it. We keep that record, we may require a copy of the release itself before generating, and we will not generate from a photograph of a real person without the confirmation. This is deliberate rather than administrative: Utah makes whoever provides the means of making a likeness answerable unless it took reasonable steps to ensure consent was obtained, and a record is what those steps look like. The confirmation is being built into the plugin and the service; until it is, do not send a photograph of a real person.
9.6 You may not send: a photograph of a child; a photograph of a public figure or a performer relying on anything short of their own written release; or a photograph of a person who has died, without the written agreement of whoever holds their rights.
9.7 We may refuse or remove an Input that breaks these terms or the Content Policy.
10. Results
10.1 We claim no ownership of Results, and we assign to you whatever rights in them we are able to assign, once the Tokens for them have been paid.
10.2 We cannot promise those rights exist. In several countries a work generated by a machine, without human authorship, may not be protected by copyright at all, whoever paid for it.
10.3 Results are not unique. Similar Inputs may produce similar Results for other customers, and nothing in these terms gives you exclusivity over a Result or anything like it.
10.4 The models in Results are generated and are not meant to depict any real person. Any resemblance to a real person is unintended, unless you supplied that person’s photograph under clause 9.4.
10.5 We may keep a copy of a finished Result. You grant us a non-exclusive, royalty-free licence to keep and use finished Results for running the Service, checking its quality, investigating faults and reviewing reported abuse. This is ours to do, and it does not change what clauses 10.1 to 10.3 say about the Result itself.
10.6 What we never do with a kept Result: we do not keep the Inputs it was made from; we never keep one generated from a photograph of a real person; we do not use it to train models, ours or anyone else’s (clause 11); and we do not publish it or show it to anyone outside the people who run the Service. Clause 16 applies to whatever of yours it shows, an unreleased product included.
11. We do not train on your data
11.1 We do not use your Inputs, your Results or your body-profile values to train our own models or anyone else’s, and the providers who run the Service for us are bound not to either.
11.2 We do use counts and measurements of how the Service is used — how many Results, of what length, how often they fail — which say nothing about you, your customers or your images, to run and improve the Service.
12. What may not be made
12.1 The Content Policy is part of these terms and says what may and may not be made with the Service.
12.2 Marking a Result as generated: our part. Where the Artificial Intelligence Act (Regulation (EU) 2024/1689) applies, Article 50(2) requires the provider of a system that generates synthetic images or video to mark its outputs in a machine-readable form, detectable as artificially generated. That duty is ours, and the marking travels with the file. Article 50 has applied since 2 August 2026. No particular technique is prescribed, and marking and detection are two duties rather than one: we also provide a means of detecting the marking, because a marking nobody can check does not satisfy the Article. The California AI Transparency Act asks for the same, with particular information in the marking and a free public tool for checking it, and since 30 September 2026 it applies whatever our size. The AI disclosure says where this stands.
12.3 Disclosing to your own customers: your part. Where the law requires whoever publishes generated media to say so, that duty is yours as the publisher, and you must keep any label and any marking in place. In particular:
- Article 50(4) of that Regulation requires the deployer of a system that produces a deep fake to disclose that the content is artificially generated or manipulated. You are the deployer when you publish a Result.
- New York requires an advertisement to disclose conspicuously that a synthetic performer appears in it, where the advertiser knows one does (General Business Law section 396-b, in force since 9 June 2026). Every model in a Result is a synthetic performer within that definition.
- California requires the same from 1 January 2027, in wording substantially similar to “this performance features a synthetic performer” or “no human performer is depicted”, where the synthetic performer is prominent in the advertisement — and it does not matter whether you knew (Business and Professions Code section 17610 and following).
- Other places have begun to legislate the same way. We tell you what we know; keeping to the law where you sell is yours to do.
12.4 Our marking does not discharge your disclosure, and your disclosure does not discharge our marking. Neither of us can do the other’s part.
13. Reporting a Result or an Input, and copyright notices
13.1 If you believe something made with the Service infringes your rights or breaks the Content Policy, write to [email protected] with what it is, where you saw it, and why. We will look at every report.
13.2 We may remove a Result, refuse to generate from an Input, or freeze an Account while we look into a report.
13.3 Copyright notices. If you are in the United States, or your work is protected there, you may send a notice under the Digital Millennium Copyright Act to our designated agent:
[designated agent name and postal address: to be filled in and registered with the United States Copyright Office before publishing] Email: [email protected]
13.4 A notice must include: your physical or electronic signature; what copyrighted work you say is infringed; what material you say infringes it, and where on the Service it is, in enough detail for us to find it; how to reach you; a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law; and a statement, made on penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.
13.5 We will remove or disable access to material that a proper notice identifies, and tell the customer who sent it.
13.6 Counter-notice. That customer may send a counter-notice including: their signature; what material was removed and where it was; a statement, made on penalty of perjury, that they believe in good faith it was removed by mistake or misidentification; their name, address and telephone number; and consent to the jurisdiction of the federal court for the district of their address, or, if they are outside the United States, of any district where we may be found, and to accept service from the person who sent the notice. We may restore the material ten to fourteen business days after we pass the counter-notice on, unless we are told that court action has been filed.
13.7 Repeated infringement. We will terminate, in appropriate circumstances, the Account of anyone who repeatedly infringes the rights of others.
13.8 We keep our designation of that agent current with the United States Copyright Office, which requires it to be renewed every three years, and we publish the agent’s details here as well, because the Act requires both.
13.9 Sending a notice or a counter-notice that knowingly misrepresents the position may make you liable for damages under section 512(f) of that Act.
14. Personal data
14.1 We handle personal data as the privacy policy describes. Where we process personal data on your behalf, the DPA applies, and you are responsible for having a lawful basis for sending it to us.
15. Our rights, your feedback, and saying who our customers are
15.1 The Service, other than the Plugin’s code and your Inputs and Results, is ours or our licensors’. Nothing here transfers it to you.
15.2 If you send us an idea or a suggestion, we may use it without owing you anything and without keeping it confidential.
15.3 We will not use your name or logo publicly without your written agreement.
16. Confidentiality
16.1 Each of us may learn things about the other that are not public. Neither of us will use them except for this agreement, or share them except with people who need them and are bound to keep them confidential.
16.2 This does not cover what is already public, what was already known, what is learned independently, or what the law requires be disclosed.
16.3 These duties last for three years after the agreement ends, and for as long as the law protects a trade secret.
17. Other people’s software
17.1 The Service includes software from others, including open-source software. Where that software comes with its own licence, that licence governs it, and prevails over these terms for that software.
18. Features still being tried
18.1 We may mark a feature as a preview, a pilot or an early version. Such a feature may change or be withdrawn, may not work, and comes with no promises at all. Clause 22.4 caps our liability for it separately.
19. Suspending, freezing and ending
19.1 You may stop using the Service at any time, disconnect your stores, and ask us to close your Account.
19.2 We may suspend or freeze an Account, so that nothing new is generated with it, where these terms or the Content Policy are broken, where a payment is reversed or suspected of fraud, where the law requires it, or where the Service or others are at risk. A frozen Account keeps its balance, its usage record and the Results already delivered.
19.3 We may end this agreement on 30 days’ notice, or at once where the breach is serious or repeated, or where the law requires it.
19.4 When the agreement ends: your right to use the Service stops; unspent Tokens end, except where the refund policy gives you a refund or the law requires otherwise; we delete personal data as the DPA says; and Results already in your media library stay yours. Removing the Plugin does not delete them.
19.5 Clauses 2, 7.2, 7.6, 8, 9.3, 10, 11, 15, 16, 19.4, 19.5, 20, 21, 22, 23, 25 and 26 survive the end of this agreement.
20. What we promise, and what we do not
20.1 We will provide the Service with reasonable skill and care.
20.2 Otherwise the Service is provided “as is” and “as available”. To the extent the law allows, we exclude every other warranty, express or implied, including any implied warranty of merchantability, any implied warranty of fitness for a particular purpose, and any warranty of accuracy, quiet enjoyment or non-infringement. This exclusion is meant to be conspicuous, and you should read it before you rely on the Service.
20.3 In particular, we do not promise that a Result will be accurate, suitable for sale, free of flaws, or fit to publish without your review. Look at a Result before you publish it.
21. Claims from others
21.1 You will defend us against any claim by someone else arising from your Inputs, from how you publish or use a Result, or from your breach of these terms or the Content Policy, including a claim that a person’s name, image, likeness or voice has been used without their agreement, and you will pay the damages, costs and reasonable legal fees finally awarded or agreed in settlement.
21.2 We will tell you promptly of such a claim, let you control the defence, and help you at your cost. You may not settle a claim in a way that admits our fault or binds us, without our agreement.
22. Limits on liability
22.1 Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
22.2 Neither of us is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, anticipated savings, or data, however it arises.
22.3 Our total liability for all claims arising in any twelve-month period is limited to the greater of: the amount you paid us for Tokens in the twelve months before the claim arose, and US$100.
22.4 For the Free Allowance and for features still being tried, our total liability is limited to US$100, whatever clause 22.3 would otherwise give. Those are provided at no charge, with no service level and no warranty, and we may change or withdraw them.
22.5 Clauses 22.2 to 22.4 do not limit your obligations to pay what you owe or to defend us under clause 21.
22.6 A claim must be brought within twelve months of the day the claimant knew, or ought to have known, of the facts giving rise to it, to the extent the law allows such a limit.
23. If you are a consumer
23.1 These terms are written for businesses. If, despite clause 1.3, you are a person acting outside a trade, business or profession, the law where you live may give you rights that cannot be signed away, including a period in which you may change your mind.
23.2 Nothing in these terms takes those rights away, and where a clause here conflicts with such a right, that right prevails.
23.3 If you are a consumer in the European Union or the United Kingdom, you have 14 days from buying Tokens to change your mind, whether or not you have spent any of them. Where you have spent some, we keep an amount in proportion to what you have used and return the rest. Buying Tokens is not the supply of digital content, so the exception for digital content does not apply to it, and a pack with Tokens left in it has not been fully performed, so the exception for a service fully performed does not apply either.
23.4 Generating a Result is a service you ask for individually. Where you ask us to begin generating inside those 14 days, you consent to us starting and you acknowledge that the Result, once made, has been supplied; the right in clause 23.3 still applies to the rest of the pack.
24. Export control and sanctions
24.1 You confirm that you are not subject to sanctions that would forbid us dealing with you, that you are not located in a country under a comprehensive embargo, and that you will not use the Service where the export control or sanctions law of Israel, the European Union or the United States forbids it.
24.2 We, or our payment provider, may screen an Account against sanctions lists, and we may refuse or end an Account that such a screening flags.
25. Changes to these terms
25.1 We may change these terms. We will publish the changed version here with a new date and, where a change matters to you, tell you at least 30 days before it takes effect.
25.2 Continuing to use the Service after that means you accept the change. If you do not, stop using the Service and ask us to close your Account; clause 19.4 then applies.
26. General
26.1 Law and courts. This agreement is governed by the law of the State of Israel, and the courts of Tel Aviv-Jaffa have exclusive jurisdiction [to be confirmed by the business]. We may nonetheless bring a claim for unpaid sums, or to protect our intellectual property, in any court where you are. If you are a consumer, this clause does not deprive you of the protection of the law where you live.
26.2 Claims are brought individually. To the extent the law allows, each of us may bring a claim only on its own behalf, and not as a claimant or class member in a class, collective or representative action.
26.3 Notices. We write to the email address on your Account; you write to [email protected]. A notice is given when sent, unless it bounces.
26.4 Assignment. You may not transfer this agreement without our written agreement. We may transfer it to a company that takes over the business, on notice to you.
26.5 Things outside our control. Neither of us is liable for a failure caused by something beyond reasonable control, including the failure of a provider on whom the Service depends.
26.6 Severability. If a clause is unenforceable, the rest stands.
26.7 No waiver. Not enforcing a clause once does not waive it.
26.8 Whole agreement. These documents are the whole agreement between us about the Service, and replace anything said before.
26.9 Nobody else. Nobody other than you and us may enforce this agreement.
26.10 Independent businesses. Nothing here makes either of us the other’s agent, partner or employee.
26.11 Language. These terms are written in English, and English governs, whatever translation is provided.
